Terms of Service

Use your media. Respect everyone else's.

These terms apply to the Nexosa website, Windows, macOS and Linux desktop app, Android app, downloadable server and connected account features. The Nexosa apps and server are free, self-hosted media-center software intended primarily for personal and household use. An optional paid plan, Nexosa Premium, is described in section 4.

1. Who provides what

Victor GumiƄski publishes the Nexosa website and software through the Nexosa Media Center project in Norway. A person or organization that installs and runs a Nexosa server is the "server operator". The publisher does not operate every server, control its media library or receive its account data.

A server operator may present a server-specific copy of these terms that identifies their contact, access rules and local service details. Those additions apply to that server. They cannot remove rights you have under mandatory law.

2. Accepting the terms

By downloading, installing, running or using Nexosa after the effective date, you agree to these terms. Account creation also presents the applicable terms before sign-up and records the version accepted. If you do not agree, do not create an account or use the software. You may uninstall the apps and ask the server operator to delete an existing account.

You must be able to enter a binding agreement where you live. A parent or guardian must approve use by a child who cannot enter the agreement alone.

3. Permission to use Nexosa

Subject to these terms, the publisher gives you a limited, non-exclusive, non-transferable and revocable permission to download, install and use the released Nexosa applications for lawful personal or household purposes. The apps and the server need no subscription; Nexosa Premium is optional. This permission does not transfer ownership of the software, branding, artwork or documentation.

Third-party components keep their own license terms. Builds include LibVLC and its required notices under the GNU Lesser General Public License. Those notices ship with each app and are not limited by these terms.

4. Nexosa Premium

Nexosa Premium is an optional paid plan that unlocks extra features in the apps and the server. It costs 5 USD a month or 50 USD a year, converted into your own currency at the checkout, and is sold as a membership through Buy Me a Coffee, which takes the payment under its own terms. The publisher never sees your card details.

A one-off contribution on Buy Me a Coffee is a gift and nothing else. It is not a membership, it grants no Discord role, and it unlocks nothing in the apps. Only the monthly or yearly membership does that.

Membership comes with a role in the Nexosa Discord server, and that role is what the apps check. You link a device by signing in with Discord on the Nexosa website, which reads only your Discord user id and your roles in that server. The device then holds an entitlement that lasts thirty days and renews itself for as long as the role remains. Anyone in a household who holds an entitlement may hand it to the household's server.

One of the features is remote access through a relay the publisher runs. The relay carries connections between your devices and your own server, encrypted end to end with a key only your server holds; it does not store or serve your media and is not a hosting service. It is offered as long as the plan is, may be unavailable for maintenance, and may be withdrawn from a household that uses it for anything other than reaching its own server. The name you choose for your server on the relay stays yours while your server uses it and for a week after.

A membership renews until you cancel it on Buy Me a Coffee. Cancelling stops the next payment; the features stay on until the paid period you have already paid for ends, and switch off when it does. The fourteen days of grace an entitlement carries are for a renewal that could not be made, such as a network or a website that was down, so that an outage does not cut a film short; they are not a fortnight added to a membership that has ended. Nothing you own or have stored is removed when Premium ends. The features simply switch off.

Under EU and Norwegian consumer law you may withdraw from a purchase of digital content within fourteen days, and the Refund Policy says how. Ask Buy Me a Coffee first; if it cannot help, write to the publisher named on the notice page within those fourteen days and the payment is returned. A price change applies only to future periods and is announced at least thirty days ahead. If the publisher removes a Premium feature or ends the plan, the unused part of a yearly period is refunded.

One membership is for one household. Sharing it beyond your household, or working around the check, ends it without refund.

5. Accounts and server access

  • Use accurate account information and protect your password and devices.
  • An account belongs to one independently operated server environment. It does not create a right to use another household's server or library.
  • The server operator decides who the server serves and may use an email allow list. A refused account may still use the in-app deletion flow.
  • Do not share account tokens, stream tickets or authenticated download links.
  • Tell the server operator promptly if you believe an account or device has been compromised.

6. Media rights

You and the server operator are responsible for the media placed in, indexed by or streamed through a server. Use only material you own, have permission to use, or may lawfully use under an applicable exception.

Norwegian Copyright Act section 26 permits limited copying of a lawfully published work for private use, subject to its conditions. It does not give permission to make that copy available to the public, which is the right section 3 of that Act reserves to the rights holder. Opening a server to people beyond your close family and personal friends is making it available, whether or not anybody is charged for it, and a private-use copy does not carry a permission to do that. Do not open a household library to people outside the private circle unless the relevant rights permit it.

7. Internet radio

Both apps can play internet radio, listed by an open directory called Radio Browser that the publisher does not run. Playing a station connects your device to that broadcaster's own live stream, the same as opening the stream in a browser. Neither app records, saves, converts or re-transmits what a station sends, and no station passes through a Nexosa server.

Nexosa therefore makes nothing available to the public here: the broadcaster does, and their own terms apply between them and you. A station that is offline, that has moved or that is transmitting something it should not is a matter for that broadcaster, and in some countries for the regulator of the place it transmits from. Neither the publisher nor a server operator can take a station off the air, and neither claims any right in what one sends.

The directory's station list is compiled and licensed by that project. Nexosa displays it and keeps a copy of the stations you choose to keep, on your device, so they still work with the network off.

8. What Nexosa will not do

Nexosa has no ripping, no transcoding to a file you keep, no download of anything a server serves, no peer-to-peer, no public catalogue and no facility for defeating a technical protection measure on anything. Section 100 of the Norwegian Copyright Act forbids circumventing such measures, and Nexosa offers no way to do it and will not be given one. A Nexosa server reads files an operator already has on their own disk and streams them to screens the operator has allowed.

The apps show the artist, title and album a file already carries, and the project publishes the notices for the software it is built from. Section 5 of that Act protects an author's right to be named, and stripping the credits from somebody's work before passing it on is not something Nexosa does or is for.

9. Prohibited use

You must not use Nexosa to:

  • store, stream, distribute or promote illegal material or material you have no right to use;
  • infringe copyright, privacy, confidentiality or other rights;
  • access another profile, library, server or device without permission;
  • bypass authentication, access restrictions, rate limits or security controls;
  • introduce malware, disrupt a service, scan for vulnerabilities without authorization or interfere with other users;
  • misrepresent your identity, the source of a build, or an affiliation with the Nexosa project; or
  • use Nexosa in a way that violates applicable law or causes the publisher or operator to violate it.

10. Third-party providers

Authentication, hosting and downloads may be delivered by third parties. Their own terms and privacy rules apply to their services, and Nexosa does not control their availability, accuracy or security.

Nexosa Premium is sold through Buy Me a Coffee and checked through Discord. Both apply their own terms to your accounts with them, and Nexosa cannot restore a membership or a Discord account that either of them closes.

The server operator is responsible for selecting and configuring the authentication and hosting providers their own server uses.

11. Updates and security

Nexosa may offer updates that fix defects, improve security or change features. The apps tell you when an update is available and wait for your action before downloading or installing it. You are responsible for keeping the app, server, operating system and third-party services reasonably current.

Internet-facing servers must use HTTPS, restrict access, protect credentials, keep backups where appropriate and follow the security guidance shipped with the server. Never publish secrets or access tokens.

12. Reports and enforcement

Report suspected illegal content, infringement, abuse or unauthorized access to the operator of the server involved. A report should identify the exact item and where it appears, explain why it is unlawful or violates these terms, provide a way to reply and confirm that the report is made in good faith. Do not send a password or access token.

The apps do this for you rather than leaving you to find the address. A server item carries its own report action, which asks what is wrong, why, and for the good-faith confirmation, will not send without all three, and stores the notice on that server for its operator. A concern about a server rather than one of its files is written for you and handed to your own mail program, addressed to the contact that server publishes. Both show you who is being written to before anything leaves your device.

You are then told what was decided. "What you reported", under tasks on the desktop and on the Android Profile tab, shows the decision written out: what was actually done, on what ground, the operator's own reason, whether anything was automated, and what you can do next. If you think it is wrong you can say so there, once, free, for six months from the decision, and it goes back to the same operator to look at again. Withdrawing a decision reopens the report rather than closing it. None of that limits your right to go to a court where you live.

The server operator may investigate, restrict access, remove an allow-list entry, remove content they control or delete an account where reasonably necessary. Nexosa has no automated moderation or automated suspension system. Enforcement decisions are made by a person, must not be arbitrary and remain subject to applicable law. Where the law requires it, the operator must acknowledge a report, explain its decision and identify available ways to challenge that decision.

13. Digital Services Act

The EU Digital Services Act, Regulation (EU) 2022/2065, applies to providers of defined intermediary services. The publisher currently provides downloadable software and an informational website. It does not operate users' servers or store and disseminate information that server users submit. Nexosa is not designed as a public content-sharing platform, marketplace or social network.

A private household server does not become an online platform merely because approved household members can connect to it. An operator that offers Nexosa as a commercial, public or user-content hosting service must assess its own role and territory. If the Digital Services Act applies, that operator is responsible for all duties relevant to its classification, including:

  • publishing the required electronic points of contact for authorities and service recipients;
  • describing content restrictions, moderation tools and enforcement procedures clearly in its terms;
  • providing an accessible electronic notice-and-action mechanism for allegedly illegal content;
  • processing notices promptly, diligently, objectively and without arbitrary treatment;
  • giving confirmations, decisions, statements of reasons and redress information where required;
  • making required reports to authorities and publishing transparency reports unless an exemption applies; and
  • respecting the prohibition on imposing a general obligation to monitor user information.

Article 19 disapplies most of Section 3 for a qualifying micro or small online platform. Article 15 has a separate micro and small enterprise exception. A server's physical location in a home does not decide whether its operator is an enterprise or whether the service meets the DSA definitions. The software provides notices, statements of reasons and a complaint route regardless. Out-of-court dispute settlement under Article 21 is an operational duty: an operator to whom that article applies must identify a certified body and engage with it as required.

The Digital Services Act does not replace the GDPR. Personal data contained in a report, investigation or decision must also be handled under the Privacy Policy and applicable data-protection law.

14. Leaving Nexosa

You may sign out, remove a local profile, clear watch history, export server data and delete your account through the apps. Uninstalling an app removes that installation but does not by itself delete a server account. Use the in-app account deletion action for that purpose.

These terms end when you stop using Nexosa and delete any account, but provisions about ownership, lawful media, disclaimers, liability and disputes continue where their nature requires it.

15. Availability and warranties

Nexosa is provided "as is" and, apart from Nexosa Premium, free of charge. To the extent permitted by law, the publisher and server operator do not promise uninterrupted availability, compatibility with every device, preservation of a media library or that every third-party service will remain available. Keep independent copies of media and configuration you cannot replace.

Nothing in these terms excludes a warranty, remedy or consumer right that mandatory law does not allow the parties to exclude.

16. Liability

To the extent permitted by mandatory law, the publisher is not liable for media loss, loss of settings, service interruption, third-party content, unauthorized server configuration or indirect loss arising from free use of Nexosa. A server operator remains responsible for their server, library, users, providers and legal obligations.

These limits do not apply to liability that cannot lawfully be limited, including liability caused intentionally or, where applicable, by gross negligence.

17. Changes

The publisher may update these terms for legal, security or product reasons. A material change receives a new effective date and should be shown before it applies to an account. Continued use after valid notice means the updated terms apply, except where mandatory law requires express acceptance or another procedure.

18. Law, disputes and contact

These terms are governed by Norwegian law. Mandatory consumer protections and jurisdiction rules in your country remain unaffected. Try to resolve a dispute with the publisher or relevant server operator first. If that does not work, disputes may be brought before the competent Norwegian courts or another court required by mandatory law.
